Man who attacked security guard Thava Sagayam for not allowing his son to use of the pool - has been charged with Murder,

Businessmen who attacked security guard charged with murder

IPOH - A tenant of a condominium who attacked a security guard last year was arraigned in the Ipoh Magistrate's Court on Thursday on murder charges.

The accused, Ahmad Noor Azhar Muhammad, 33, was previously charged on January 6 under Section 335 of the Penal Code for intentionally causing serious injury due to anger.

However, the charges against the businessman were changed following the death of the victim, S Thava Sagayam, 64, who was previously treated at the Raja Permaisuri Bainun Hospital (HRPB) on August 27.

The accused's case should have been mentioned again on Thursday but the court allowed the prosecution's application to withdraw the charge and replace it with Section 302 of the Penal Code following the victim's death.

For the new charge, no confession was recorded from the accused after the charge was read before Magistrate Noor Azreen Liyana Mohd Darus.

According to the charge, the accused is alleged to have killed Thava Sagayam on the 7th floor, Menara Majestic, Jalan CM Yusuff, here between 8am and 9.30am on December 29, 2020.

He was charged with the offense under Section 302 of the Penal Code which if convicted carries a mandatory death sentence.

The prosecution was conducted by Perak State Director of Prosecution, Azlina Rasdi while the accused was represented by lawyer Ariff Azami

The court then set October 18 as the re -mention of the case.

On Aug 27, the late Thava Sagayam died after a long illness following being attacked by a man who was unhappy because he allegedly tried to stop his son from using the swimming pool in a condominium that was not open to the public on Dec 29 last year.
